Washington, D.C.—U.S. Congressman Andy Barr (R-KY) is again leading the charge to ban biological men from invading girls’ sports. Barr joined a slew of members of Congress and U.S. Senators who wrote an Amicus Brief urging the Supreme Court to uphold state bans on biological men participating in girls’ sports in the upcoming State of West Virginia v. B.P.J and Little v. Hecox case.

The brief argues that when Congress enacted Title IX in 1972, it defined “sex” in biological terms—not as “gender identity”—and that only Congress, not the courts, has the authority to change that definition. You can read the full brief here.

“The text of Title IX uses ‘sex’ to mean biology—not gender identity,” the Amicus Brief reads in part. “Because Title IX was enacted under the Spending Clause, its requirements must be clear and unambiguous, and those provisions say nothing about gender identity. Congress should be given the option and ability to consider the policy implications of importing gender identity into the text of Title IX.”

“We must fight in Court, in Congress, and in every community to ensure President Trump’s Executive Order protecting our girls is preserved,” said Congressman Barr. “Men do not belong in women’s sports and I will continue to work alongside President Trump, my colleagues in Congress, and activists like Riley Gaines to protect female athletes and their private spaces.”

 “West Virginia passed a law making it clear that men shouldn’t play in women’s sports. This is just common sense – men and women are biologically different. Men cannot become women and they certainly shouldn’t be forced to compete together. We have a duty to protect our children and ensure that no more girls are injured by transgender athletes pretending to be women. I’m proud to lead this bicameral amicus brief with Sen Jim Risch (R-Idaho) in defense of protecting women’s sports at the Supreme Court,” said Congressman Riley M. Moore (WV-02), who led the Amicus Brief.

Barr also authored and introduced the Defend Girls’ Athletics Act, legislation that is endorsed by women’s sports and conservative activist Riley Gaines, to cut off federal funds to any school that refuses to implement President Donald Trump’s national ban on biological men participating in girls’ sports.

Biological males are depriving female athletes of their athletic achievements. According to the United Nation’s 2024 study titled “Violence against women and girls in sports,” biological males have won 890 medals in 29 different women’s sports.  The study also estimated that over 600 female athletes have lost accolades because of male athletes participating in their sport. 

Even worse than stealing glory from our female athletes, some girls have suffered permanent injury because of competing against biological males in sports. One of these athletes is Payton McNabb, who suffered partial paralysis during a high school volleyball match in 2022 due to an injury caused by a biological boy.
